Terms of Service

These Terms of Service ("Terms") govern your use of the Gamified Lives mobile application ("App") operated by Kevin Castaneda ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account

You may sign in using Apple or Google authentication. You are responsible for maintaining the security of your account credentials. You agree to provide accurate information and to keep your profile information up to date.

You may not create accounts for the purpose of abusing app features, manipulating leaderboards, or harassing other users.

3. Use of the App

The App is a personal self-improvement tool designed to help you track habits, set goals, and build positive routines through gamification. You agree to use the App only for its intended purpose and in compliance with all applicable laws.

4. AI-Generated Content

The App uses artificial intelligence services to generate avatars, provide coaching, verify tasks, and create reports. AI-generated content is provided "as is" and may not always be accurate, complete, or appropriate.

The AI Advisor is not a licensed therapist, counselor, or medical professional. Its responses are for informational and motivational purposes only and should not be treated as professional advice. If you are experiencing a mental health crisis, please contact the 988 Suicide & Crisis Lifeline (call or text 988) or your local emergency services.

You retain ownership of photos you upload. By uploading a photo for avatar creation or task verification, you grant us a limited license to transmit that image to our AI service providers for processing. Photos are not stored on our servers after processing is complete.

5. Premium Subscription

Gamified Lives offers a Premium subscription with additional features. Subscriptions are billed through Apple's App Store at the following rates:

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your Apple ID settings.

A 7-day free trial may be offered to new subscribers. If you do not cancel before the trial ends, you will be charged for the subscription.

Refunds are handled by Apple according to their refund policy. We do not process refunds directly.

6. Virtual Currency and Cosmetics

The App includes a virtual currency ("coins") and virtual cosmetic items. These have no real-world monetary value and cannot be exchanged, transferred, or refunded for real currency. We reserve the right to modify the virtual economy, including prices, rewards, and availability of items, at any time.

7. Squads and Communities

The App includes social features such as squads and communities. When you join a squad, your display name, level, streak, and daily task count are visible to other squad members. Community posts are visible to all members of that community.

You are responsible for the content you post. We reserve the right to remove content and suspend accounts that violate these Terms or our community standards, including content that is offensive, harassing, spam, or otherwise inappropriate.

8. Intellectual Property

The App, including its design, code, features, and content (excluding user-generated content and AI-generated avatars), is owned by Kevin Castaneda and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You own your AI-generated avatar and may use it for personal purposes. You may not use the App's branding, logo, or design elements without prior written permission.

9. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components. We make no warranties regarding the accuracy or reliability of AI-generated content, including avatars, coaching advice, and task verification results.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or damages resulting from reliance on AI-generated content.

Our total liability for any claim arising from the App shall not exceed the amount you paid for Premium subscriptions in the 12 months preceding the claim, or $50, whichever is greater.

11. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

12. Account Termination

You may delete your account at any time through the App's settings. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your right to use the App ceases immediately. Local data remains on your device until you uninstall the App.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website or within the App. Your continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.
